Please clarify edition required for APEX code

Hi,
 
I've seen in the edition comparison that only the developer and unlimited editions have APEX. Does that mean that if I develop an AppExchange offering that uses APEX that it can only be used by customers with the unlimited edition?

You have to ask salesforce to enable the apex in your login and then you can deploy your apex code in even enterprise edition.

Apex is available in Enterprise Edition for a fee. So if you develop an app incorporating Apex code it can be sold to Developer Edition Customers, Unlimited Edition Customers, and Enterprise Edition customers that have paid for Apex to be enabled.

This is true that you can develop and deploy to these type of users but I do not believe it would be through the AppExchange as AppExchange Packages do not currently support Apex. It would be a normal deploy so the code would be visible to the users. If its a custom job, no worries, otherwise there is IP you would want to protect.
