What stops people from using the free Developer edition for small business?

So what stops someone from creating a Developer account and just adding users etc.,?

Assuming the company is small, couldn't they just do that?

Developer Edition is very limited (https://help.salesforce.com/apex/HTViewHelpDoc?id=limits_general.htm&language=en_US) - only 2 CRM licenses, only 5MB of data storage, 20MB file storage etc. Even a small company would quickly run up against the limits.

But it's enough for me to get in there, set up some trivial things and let a few of the staff check it out and evaluate it for our purposes?

Technically they can. Legally they can't as per Salesforce Terms & Conditions available at http://www.salesforce.com/assets/pdf/misc/salesforce_Developer_MSA.pdf (refer to the 1st page of the document).
